Welcome to AI ID Photo Maker & Passport (the “App”). Please read these Terms of Service (the “Terms”) and our Privacy Policy carefully before using the App. By downloading, installing, registering, logging in, or using the App, you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the App.
1. Service Description
1. The App is a utility that provides ID photo shooting, cropping, background replacement, beauty editing, HD export, and monthly premium subscription membership services, focusing on creating official ID photos such as passports, visas, and ID cards. 2. The App provides technical tools only. We do not guarantee that all generated ID photos will meet the specific standards of all official authorities (e.g., immigration, visa, household registration, exams). Final compliance is subject to the on-site review of the relevant authority. 3. We reserve the right to optimize, upgrade, or adjust services at any time without prior notice, but will notify users of material changes within the App.
2. Eligibility
1. You must beat least 18 years old to use the App independently. If you are under 18, you may use the App only with the consent and supervision of a legal guardian, who shall be responsible for your activities. 2. You represent and warrant that any photos you upload or take using the App are of yourself or you have obtained legal authorization from the right holder, and do not infringe on others’ portrait rights, privacy rights, copyrights, or other legal rights.
3. Intellectual Property
1. All intellectual property rights in the App, including code, interface, text, icons, templates, algorithms, and technology, are owned by us and protected by copyright, trademark, and other laws. 2. You are granted a limited, non-exclusive, non-transferable, non-sublicensable license to use the App. You may not copy, modify, reverse-engineer, crack, distribute, or use the App for commercial resale. 3. You own the copyright to ID photos you create and export using the App. However, you grant us the right to use such photos in an anonymous, de-identified manner for technical optimization and model training (without disclosing your personal identity).
4. Subscriptions & Payments（Apple Review Critical）
1. Premium Subscription: The App only offers auto-renewable monthly membership (“Premium ID Photo Membership”). Prices are displayed in the App’s purchase page, with a subscription cycle of 1 month. 2. Auto-Renewal Rules: - Your subscription will auto-renew and be charged via your Apple ID 24 hours before expiration for the next month; - You may cancel anytime in App Store → Account → Subscriptions. Cancellation takes effect at the end of the current billing cycle; no refunds for partial periods; - Free trials (if offered) will convert to monthly paid subscriptions if not canceled before the trial ends. 3. Refunds: All subscription fees are collected by Apple. Refund requests must be submitted to Apple. We do not process refunds directly and do not guarantee approval. 4. Benefits: Premium benefits include unlimited creations, HD exports, watermark-free, all templates. Benefits are non-transferable and non-redeemable for cash.
5. User Conduct
You agree not to: - Upload/take photos of others, fake identities, or impersonate others; - Generate illegal, pornographic, violent, sensitive, or infringing content; - Crack, modify, or attack the App or servers; - Use the App for commercial mass production, sales, or distribution; - Violate laws, public order, or these Terms. We may suspend/ban your account, delete content, or refuse service for violations, and reserve the right to pursue legal remedies.
6. Privacy
Your personal data is protected by our Privacy Policy: Privacy Policy We comply with applicable laws to protect your photos, device info, and subscription dataand will not disclose it to unauthorized third parties.
7. Disclaimer of Liability
1. THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO SERVICE STABILITY, PHOTO COMPLIANCE, EXPORT QUALITY, OR DEVICE COMPATIBILITY). 2. We are not liable for losses caused by: - Your uploaded photos being infringing, illegal, or non-compliant; - Official authorities rejecting your App-generated ID photos; - Network failures, device errors, or service interruptions due to updates; - Force majeure (earthquakes, fires, policy changes, etc.). 3. Our total aggregate liability shall not exceed the total subscription fees you have paid.
8. Updates
We may update these Terms from time to time. Updated Terms will be posted in the App with a new effective date. Continued use of the App constitutes acceptance of the updated Terms.
9.Governing Law
The applicable law of these Terms is as follows: If you use the App within the People's Republic of China, these Terms shall be governed by the laws of the People's Republic of China, and disputes shall be resolved by the competent court at the defendant’s domicile. If you use the App outside China (i.e., when the App is sold overseas), these Terms shall be governed by the current and effective laws of your region/country. You shall also comply with local relevant regulations on data protection and payment supervision (such as EU GDPR, relevant regulations of Brazil CADE, relevant U.S. regulatory requirements, etc.), and disputes shall be resolved by the competent authority in your region. If the laws of your region conflict with the terms of these Terms, the local laws shall prevail.
